AUTOCOMPOSIÇÃO DE CONFLITOS: DA CULTURA DE LITIGÂNCIA À SOLUÇÃO CONSENSUAL.

A RESPONSABILIDADE CIVIL PELO ABUSO DO DIREITO À LIBERDADE DE EXPRESSÃO EM CONFLITO COM OS DIREITOS DA PERSONALIDADE: UMA ANÁLISE DO CASO DAS BIOGRAFIAS NÃO AUTORIZADAS.

RESUMO Este artigo apresenta e discute acontecimentos que emergiram no decorrer de uma pesquisa-intervenção com jovens, visando problematizar as contribuições para a formação ética, estética e política tanto dos pesquisadores como dos participantes. Oficinas estéticas mediadas por linguagens artístico-visuais consistiram no modus operandi da pesquisa-intervenção, sendo os acontecimentos relativos à oficina de graffiti o foco das análises aqui apresentadas. Participaram dessa oficina entre 20 a 25 jovens matriculados em uma escola pública municipal de Florianópolis/SC, com idades entre 13 e 16 (...) anos. As atividades foram coordenadas por bolsistas de IC e extensão, graduandos de psicologia, e um bolsista AT, grafiteiro. Os registros das atividades foram feitos via filmagens, fotografia e registros em diário de campo. As análises foram realizadas a partir de uma perspectiva dialógica, com foco na responsividade que conota as ações e pauta a condição alteritária da existência.ABSTRACT This paper presents and discusses events that emerged in the course of research involving an intervention conducted with youngsters. The objective was to discuss contributions to ethical, aesthetic and political formation of both the researchers and participants. Aesthetic workshops mediated by artistic-visual languages consisted of the modus operandi of the intervention research, and the events related to a graffiti workshop were the focus of this analysis. From 20 to 25 youngsters, aged between 13 to 16 years old and enrolled in a city public school in Florianópolis, SC, Brazil participated. The activities were coordinated by undergraduate research assistants, senior psychology students, and one graffiti artist who received a Technical Support scholarship. The activities were filmed, photographed and recorded in a field diary. The analyses were conducted from a dialogic perspective focusing on responsiveness that connotes the actions and grounds the otherness nature of existence. (shrink)

Neste artigo pretendemos compreender se, e de que forma, o cinema pode servir a uma cosmopoética do pensamento decolonial. Para tanto, nos apoiaremos em alguns conceitos dos estudos decoloniais, que buscam atualizar a tradição crítica do pensamento latino-americano a partir da problematização do pensamento hegemônico, oferecendo novas releituras histórias e novas possibilidades de produção dos saberes. A perspectiva decolonial opera fornecendo novos horizontes para o pensamento, promovendo uma ecologia dos modos de saber e conhecimento não reconhecidos pelas epistemologias dominantes. Assim, (...) buscamos entender a potência cosmopoética do cinema e como ele pode contribuir, dentro dos espaços de educação, como alternativa epistemológica para o pensamento decolonial. (shrink)

È questa la prima immagine che appare a Emanuele Severino quando, errando tra i ricordi, riavvolge i fili della propria esistenza. Errando, appunto, perché il ricordo è di per sé falso e distratto. Tra aneddoti e suggestioni, riaffiorano l'infanzia a Brescia e gli anni della guerra; la scomparsa del fratello Giuseppe, arruolatosi come "volontario" sul fronte francese, e l'incontro con Esterina, (...) "la ragazza più bella di Brescia", che diventerà sua moglie ed è lo sfondo di queste pagine; gli studi universitari a Pavia e l'insegnamento alla Cattolica di Milano, a seguito del "maestro" Gustavo Bontadini; la controversia con la Chiesa, che nel 1970 proclamò l'incompatibilità delle sue posizioni con quelle della dottrina cattolica; il rapporto con i figli; la stesura delle sue opere e le conversazioni filosofiche con gli amici. This study focuses on retraction notices from two major Latin American/Caribbean indexing databases: SciELO and LILACS. SciELO includes open scientific journals published mostly in Latin America/the Caribbean, from which 10 % are also indexed by Thomson Reuters Web of Knowledge Journal of Citation Reports. LILACS has a similar geographical coverage and includes dissertations and conference/symposia proceedings, but it is limited to publications in the health sciences. A search for retraction notices was performed in these two databases using the keywords “retracted”, (...) “retraction” “withdrawal”, “withdrawn”, “removed” and “redress”. Documents were manually checked to identify those that actually referred to retractions, which were then analyzed and categorized according to the reasons alleged in the notices. Dates of publication/retraction and time to retraction were also recorded. Searching procedures were performed between June and December 2014. Thirty-one retraction notices were identified, fifteen of which were in JCR-indexed journals. “Plagiarism” was alleged in six retractions of this group. Among the non-JCR journals, retraction reasons were alleged in fourteen cases, twelve of which were attributed to “plagiarism”. The proportion of retracted articles for the SciELO database was approximately 0.005 %. The reasons alleged in retraction notices may be used as signposts to inform discussions in Latin America on plagiarism and research integrity. At the international level, these results suggest that the correction of the literature is becoming global and is not limited to mainstream international publications. (shrink)

In diesem Essay wird mit den Mitteln der Sprachphilosophie ge­zeigt, dass vermutende Sprechakte für die Krisenkommunikation in der Corona-Pandemie richtig und wichtig sind. Weder sind Vermutungen anfälliger für Unklarheit als andere Sprechakte noch sind sie besser dazu geeignet, Verantwortung abzuweisen. Im Gegen­teil: In einer Situation, die durch Unsicherheit geprägt ist, sind Vermutungen besonders wertvoll für das (...) Kommunizieren ungesicherter Hypothesen. (shrink)

To understand the endogenous components of the event-related brain potential (ERP), we must use data about the components' antecedent conditions to form hypotheses about the information-processing function of the underlying brain activity. These hypotheses, in turn, generate testable predictions about the consequences of the component. We review the application of this approach to the analysis of the P300 component. The amplitude of the P300 is controlled multiplicatively by the subjective probability and the task relevance of the eliciting events, whereas its (...) latency depends on the duration of stimulus evaluation. These and other factors suggest that the P300 is a manifestation of activity occurring whenever one's model of the environment must be revised. Tests of three predictions based on this “context updating” model are reviewed. Verleger's critique is based on a misconstrual of the model as well as a partial and misleading reading of the relevant literature. (shrink)

It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. Pablo Gilabert and Holly Lawford-Smith have, both in collaboration and individually, provided a compelling account of feasibility, which states that feasibility is both ‘binary’ and ‘scalar’, and both ‘synchronic’ and ‘diachronic’. This two-dimensional analysis, however, has been the subject of four major criticisms: it has been argued that it rests upon a false distinction between ‘hard’ and ‘soft’ constraints, that it ignores the importance of intentional action, and that diachronic feasibility is incoherent and insensitive to the existence of epistemic limitations. (...) In this paper, I will argue that such objections do not undermine the persuasiveness of Gilabert and Lawford-Smith’s analysis. Nevertheless, I will contend that the latter is susceptible to two other challenges. First, it mistakenly appeals to morality, and, second, it lacks an analysis of ability. I will maintain, however, that such criticisms can be addressed and that a revised version of the account should be adopted. (shrink)

The concept of adaptation is employed in many fields such as biology, psychology, cognitive sciences, robotics, social sciences, even literacy and art,1 and its meaning varies quite evidently according to the particular research context in which it is applied. We expect to find a particularly rich catalogue of meanings within evolutionary biology, where adaptation has held a particularly central role since Darwin’s The Origin of Species (1859) throughout important epistemological shifts and scientific findings that enriched and diversified the concept. Accordingly, (...) a conceptual taxonomy of adaptation in evolutionary biology may help to disambiguate it. Interdisciplinary researches focused on adaptation would benefit from such a result. In the present work we recognize and define seven different meanings of adaptation: (1) individual fitness; (2) adaptation of a population; (3) adaptation as the process of natural selection; (4) adaptive traits; (5) molecular adaptation; (6) adaptation as structural tinkering; (7) plasticity. For convenience here, we refer to them as W-, P-, NS-, T-, M-, S- and PL-ADAPTATION. We present the seven meanings in some detail, hinting at their respective origins and conceptual developments in the history of evolutionary thought (references are offered for further deepening). However, it is important to point out that evolution researchers seldom if ever refer to a single meaning purified from the others. This applies also to the authors we cite as representatives of one of the seven meanings. In Discussion and Conclusion draw from our work some future perspectives for adaptation within evolutionary biology. (shrink)

Philo of Alexandria is a forerunner of both the union of philosophy and theology and the biblical hermeneutics of the text at various levels of deepening. Heir of a long tradition had his thinking rejected in Judaism after a break in the first century AD with Greek culture, but remained as a reference of Patristics and all Christian thinking, having a perennial influence. The hermeneutics in Philo is studied, its option for Platonism, its allegorical method and what our author sought (...) to contemplate through this method. The union of Greek, Jewish and Christian cultures is approached, seeking to analyze the complex reality that emerged from this encounter and the mark it left in the Bible, the works of Philo and the authors who were influenced by him. Drawing on evolutionary epistemology, process ontology, and a social-cognition approach, this book suggests cognitive evolution, an evolutionary-constructivist social and normative theory of change and stability of international social orders. It argues that practices and their background knowledge survive preferentially, communities of practice serve as their vehicle, and social orders evolve. As an evolutionary theory of world ordering, which does not borrow from the natural sciences, it explains why certain configurations of practices organize and govern social orders epistemically and normatively, and (...) why and how these configurations evolve from one social order to another. Suggesting a multiple and overlapping international social orders' approach, the book uses three running cases of contested orders - Europe's contemporary social order, the cyberspace order, and the corporate order - to illustrate the theory. Based on the concepts of common humanity and epistemological security, the author also submits a normative theory of better practices and of bounded progress. (shrink)

Os Discursos à Nação Alemã de Fichte foram considerados durante muito tempo uma importante contribuição para o desenvolvimento do nacionalismo alemão e do pensamento nacionalista em geral Todavia, embora os Discursos continuem sendo lidos como um prenúncio das aspirações nacionalistas alemãs, grande parte de seu contendo substantivo é hoje ignorado. Neste artigo, o Autor examina um aspecto deveras negligenciado dos Discursos, a saber, o “sistema de educação nacional” neles propostos e que merecem séria consideração pelo modo como Fichte concebe e (...) articula o papel e função da intelligentsia em busca de salvação nacional. Argumenta-se, de modo especial, que é através da exaltação da educação que Fichte legitima sua proposta de governo por uma elite erudita, um tipo de despotismo esclareci do. Mostra-se ainda que o escopo dos privilégios concedidos aos “eruditos” na reforma educacional de Fichte solapa seu potencial radicalmente igualitarista, e que sua proposta termina por mostrar-se incoerente e inconsistente em seus próprios termos, na medida em que os propósitos explícitos de seu sistema e os resultados prometidos invalidariam completamente, se levados a cabo, a reivindicação dos esclarecidos de governa, se não a necessidade de tais governantes. In Emanuel Adler's distinctive constructivist approach to international relations theory, international practices evolve in tandem with collective knowledge of the material and social worlds. This book - comprising a selection of his journal publications, a new introduction and three previously unpublished articles - points IR constructivism in a novel direction, characterized as 'communitarian'. Adler's synthesis does not herald the end of the nation-state; nor does it suggest that agency is unimportant in international life. Rather, it argues that what mediates (...) between individual and state agency and social structures are communities of practice, which are the wellspring and repositories of collective meanings and social practices. The concept of communities of practice casts new light on epistemic communities and security communities, helping to explain why certain ideas congeal into human practices and others do not, and which social mechanisms can facilitate the emergence of normatively better communities. The shooting bias hypothesis aims to explain the disproportionate number of minorities killed by police. We present the evidence mounting in support of the existence of shooting bias and then focus on two dissenting studies. We examine these studies in light of Biddle and Leuschner’s “inductive risk account of epistemically detrimental dissent” and conclude that, although they meet this account only partially, the studies are in fact epistemically and socially detrimental as they contribute to racism in society and to a (...) social atmosphere that is hostile to science as scholars working on issues of racism come under attack. We emphasize this final point via recourse to Kitcher’s “Millian argument against the freedom of research.”. (shrink)

We study the SIS and SIRI epidemic models discussing different approaches to compute the thresholds that determine the appearance of an epidemic disease. The stochastic SIS model is a well known mathematical model, studied in several contexts. Here, we present recursively derivations of the dynamic equations for all the moments and we derive the stationary states of the state variables using the moment closure method. We observe that the steady states give a good approximation of the quasi-stationary states of the (...) SIS model. We present the relation between the SIS stochastic model and the contact process introducing creation and annihilation operators. For the spatial stochastic epidemic reinfection model SIRI, where susceptibles S can become infected I, then recover and remain only partial immune against reinfection R, we present the phase transition lines using the mean field and the pair approximation for the moments. We use a scaling argument that allow us to determine analytically an explicit formula for the phase transition lines in pair approximation. (shrink)

Essas discussões foram sustentadas na análise do Pierre Bourdieu sobre as disputas percebidas do campo religioso. Destacamos suas posições a partir do que foi publicado no jornal Diário do Interior de 1930 a 1937, assim, propomos uma reflexão, da escrita na imprensa local no sentido de demarcar identidade espírita diante da pluralidade (...) de práticas mediúnicas. Este artigo intenciona compreender a dimensão discursiva das pinturas por meio da análise do discurso ancorada em Michel Foucault. Recorta-se a figura do espelho em pinturas canônicas com vistas a observar seu funcionamento discursivo enquanto elemento do enunciado artístico visual. Apresenta três partes: a primeira, que determina o lugar ocupado pelo discurso estético nos trabalhos de Michel Pêcheux e de Michel Foucault; a segunda, que se concentra na análise de três pinturas europeias, a saber, As meninas, de Velásquez; Um bar (...) em Folies-Bergère, de Manet; e As ligações perigosas, de Magritte; e a terceira parte, que discute a intersecção entre visualidade e interdiscursividade a partir (a) das reflexões de M. Foucault acerca do discurso estético e (b) da figura do espelho presente nessas pinturas. (shrink)

Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

The article examines the process of niche standardization in medical research as an example of democratizing strategies implemented in industry-funded science. I argue that niche standardization can lead to undesirable epistemic and ethical consequences, if the various goals of research are not properly aligned. I examine two examples: the case of Sarafem, approved for the treatment of premenstrual dysphoric disorder in women, and the case of BiDil, approved for exclusive use in African Americans for the treatment of congestive heart failure. Many political theorists believe that a state cannot be neutral when it comes to languages. Legislatures cannot avoid picking a language in which to conduct their business and teachers have to teach their pupils in a language. However, against that, some political liberals argue that liberal neutrality is consistent with the state endorsement of particular languages. Claims to the contrary, they say, are based on a misguided understanding of what neutrality is. I will argue that this line of argument fails, (...) for two reasons. First, the primary challenge to which political liberals should respond is not that of reconciling the promotion of languages with liberal neutrality but, rather, that of reconciling liberal neutrality with the fact that reasonable people disagree about the existence and nature of languages. Second, even if everyone accepted the existence of languages along essentialist lines, one should still doubt the possibility of state neutrality with respect to them, regardless of the conception of neutrality one prefers. The reason why is that human beings cannot care about or value languages so when a state promotes a particular language, it is not supporting the preferences of its citizens but, rather, acting on perfectionist or simply irrational grounds. Recently, Stefan Wintein published an article in which he presents four objections to my modal-epistemic argument for the existence of God. His first objection is an alleged counterexample to the argument’s first premise, and the second objection is an alleged counterexample to the argument’s second premise. Wintein’s third objection attempts to show that the modal-epistemic argument is circular. Finally, the fourth objection is a parody objection. In this paper, I show that Wintein’s four objections all fail.

The growing body of research on interdisciplinarity has encouraged a more in depth analysis of the relations that hold among academic disciplines. In particular, the incursion of one scientific discipline into another discipline’s traditional domain, also known as scientific imperialism, has been a matter of increasing debate. Following this trend, Scientific Imperialism aims to bring together philosophers of science and historians of science interested in the topic of scientific imperialism and, in particular, interested in the conceptual clarification, empirical identification, and (...) normative assessment of the idea of scientific imperialism. Thus, this innovative volume has two main goals. Indeed, the authors first seek to understand interdisciplinary relations emerging from the incursion of one scientific discipline into one or more other disciplines, such as in cases in which the conventions and procedures of one discipline or field are imposed on other fields; or more weakly when a scientific discipline seeks to explain phenomena that are traditionally considered proper of another discipline’s domain. Secondly, the authors explore ways of distinguishing imperialistic from non-imperialistic interactions between disciplines and research fields. (shrink)

We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. In arguing against a supposed ambiguity, philosophers often rely on the zeugma test. In an application of the zeugma test, a supposedly ambiguous expression is placed in a sentence in which several of its supposed meanings are forced together. If the resulting sentence sounds zeugmatic, that is taken as evidence for ambiguity; if it does not sound zeugmatic, that is taken as evidence against ambiguity. The aim of this article is to show that arguments based on the second direction of (...) the test are misguided: ambiguous expressions, and in particular philosophically contested ones, do not reliably lead to zeugmaticity, so an absence of zeugmaticity provides no meaningful evidence for an absence of ambiguity.
